These Terms and Conditions (“Terms”) govern your access to and use of the website https://visionarys.art (the “Platform”) and the services provided through it.

By creating an account, purchasing services, or using the Platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Platform.
1. Description of the Service
Visionarys.art is an AI-powered digital platform that allows users to generate visual artwork based on text prompts and selected parameters.
The Platform enables users to:
• purchase Account Balance using real money
• submit requests for AI-generated images
• generate artwork using AI technology
• download generated images
• manage request history and payment records
The service is provided as a digital content generation tool.
2. Eligibility
You must be at least 16 years old to use the Platform. If you are under 18, you confirm that you have permission from a parent or legal guardian where required by applicable law. You must provide accurate information when creating an account and keep your credentials secure.
3. User Account
To access services, you must create an account. You are responsible for:
• maintaining confidentiality of login credentials
• all activity conducted through your account
• ensuring lawful use of the Platform
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
4. Account Balance (Wallet)
The Platform operates using a prepaid Account Balance system. Account Balance:
• represents prepaid digital service value
• is not a bank account, deposit, or electronic money
• has no cash value outside the Platform
• cannot be transferred to another user
• cannot be withdrawn or redeemed for cash
Account Balance may only be used to purchase services available on the Platform. We may modify pricing or balance rules at any time.
5. Services and Pricing
Users may purchase AI image generation services including:
• Standard Request
• Premium Request
Prices are displayed before confirmation. Users may fund their Account Balance in amounts determined at checkout.
Deposit limits:
• Minimum: €5
• Maximum: €3000 per transaction
All payments are one-time purchases. There are no subscription obligations. Taxes are not applicable unless required by law. Invoices or payment confirmations may be issued electronically after successful transactions.
6. Payments and Processing
All payments are processed through licensed third-party payment service providers (“PSPs”).
The Company:
• does not store full card details
• does not directly process payment cards
• relies on PSPs for payment authorization and settlement
Transactions may be subject to:
• fraud prevention checks
• compliance reviews
• security verification
We are not responsible for delays or failures caused by banks or payment providers.
7. Refund Policy
Because the Platform provides digital content generated instantly upon user request:
All completed service transactions are final and non-refundable, except where required by applicable law.
By purchasing services and initiating generation, you:
• expressly request immediate performance of digital services
• acknowledge that delivery begins instantly
• waive any statutory right of withdrawal once the service begins
Unused Account Balance may be refundable within 14 days of purchase where:
• funds remain unused
• no fraud or compliance concerns exist
• payment method supports refunds
Refund decisions remain subject to verification and applicable law.
8. AI-Generated Content and Intellectual Property
The Platform uses artificial intelligence technologies to generate images based on user-provided prompts, selections, and inputs. Generated content is created automatically without human review and may vary in quality, accuracy, style, or relevance.
Users retain ownership rights to images generated through the Platform, subject to compliance with Terms.
You may use generated images for:
• personal purposes
• commercial purposes
However, you are solely responsible for ensuring that your prompts and use of generated content do not infringe third-party rights, including but not limited to:
• copyrighted characters
• trademarks
• protected designs
• proprietary works
• unlawful or restricted content
The Company does not verify ownership, legality, or originality of user prompts or generated outputs.
The Company does not guarantee:
• originality
• uniqueness
• non-infringement
• accuracy or quality
• suitability for specific purposes
To the maximum extent permitted by law, the Company shall not be liable for any claims, damages, losses, or disputes arising from:
• user prompts
• generated content
• use of generated images
• alleged intellectual property infringement
The Platform, including its software, algorithms, models, and technology, remains the exclusive intellectual property of the Company and its licensors.
The Company may use anonymised interaction data to improve system performance and service quality in accordance with the Privacy Policy.
9. Prohibited Use
You agree not to:
• generate illegal or harmful content
• infringe intellectual property rights
• attempt to reverse engineer the AI system
• misuse or exploit the Platform
• bypass payment systems
• engage in fraud or abuse
Violations may result in suspension or termination.
10. Anti-Fraud and Security Monitoring
We may monitor transactions and user activity to prevent fraud, abuse, or unlawful behavior.
We reserve the right to:
• delay or block transactions
• request verification
• suspend accounts
• cancel services
where suspicious activity is detected.
11. Service Availability
We aim to maintain uninterrupted service but do not guarantee availability.
The Platform may be unavailable due to:
• maintenance
• technical issues
• upgrades
• external provider failures
We are not liable for downtime or data loss.
12. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for:
• indirect or consequential damages
• loss of profits or data
• business interruption
• content outcomes
Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
13. Suspension and Termination
We may suspend or terminate accounts:
• for violations of these Terms
• for fraud or abuse
• for legal or security reasons
Termination may result in loss of access to Account Balance or generated content where permitted by law.
14. Data Protection
Personal data processing is governed by our Privacy Policy.
15. Geographic Restrictions
The Platform may not be available in jurisdictions subject to sanctions or legal restrictions. We may refuse service based on location or compliance requirements.
16. Changes to the Terms
We may update these Terms at any time. Updated versions will be posted with a revised date. Continued use of the Platform constitutes acceptance.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Czech Republic, without prejudice to mandatory consumer protections under applicable European Union law.
Any disputes shall be resolved by competent courts of the Czech Republic unless mandatory law provides otherwise.
